KaleidoArt provides services to website users and event guests, these are outlined in these terms and conditions. We reserve the right to update these terms and conditions at any time, without notice. This is the most current version of these terms and conditions. By using our website and services, you agree to these terms and conditions hereby included.
We may change or discontinue any aspect, feature or functionality of this site, without notice.
How KaleidoArt works
We are an art based entertainment service providing our customers with instructions for art at local venues, client homes, and other private locations. Through our service, we offer you a variety of resources, such as the kaleidoart.ca website and others. These resources, including all changes, updates or additions, are subject to these terms and conditions. Please note any description of our services, is not an obligation of how the service will always work.
All the images, pictures and artwork are developed for and by KaleidoArt. For this reason, you may not copy or reproduce any complete (or portion of) artwork, without our consent. We are the sole owners of all the rights to any and all artwork. By using our service, you are granted limited rights to use our art. After the event, you may take your art with you, however, you agree that you will not reproduce, copy or distribute any portion, or entirety, of your artwork for profit.
Our availability may sometimes change and could happen on the day of your event. Should a change occur, we will do our best to give you ample notice and options to reschedule your event. We cannot guarantee a specific facilitator for your event, though we will do our best to accommodate your requests.
We make no promise about the outcome of your artwork and/or personal experience when using our services. Every creation will be unique and no artwork will be exactly like that of the facilitator.
We will make our best effort to start all of our events on time and complete the instruction under 3 hours, however, sometimes the time needed to begin and complete the instruction could vary. If there are capacity limitations at a venue, you may not be able to attend an event. We may also bring changes to artwork being completed at a particular event, and this without notice.
Fees and Billing
For the purpose of this terms and conditions, billing means any charge or debit against your chosen method of payment.
A booking fee of $100 is required to secure the date of your choice. We will invoice you for the full amount (including the booking fee, which is reduced from the total amount of your invoice) of the event upon the confirmation of the number of attendees. Full payment is required prior to, or on the day of the event, unless otherwise agreed upon, at our discretion.
By giving us payment, you are agreeing that we can charge you the fee for the event as well as any other charge you may incur based to your choice of payment (such as debit or e-transfer fees, etc.). Please also note that prices and charges may change without notice. The amount billed for each event may also be different. The total amount invoiced may also change, depending on the number of attendees.
We may provide a refund, discount or promotion to some customers, at any time for any reason. This is done at our discretion. It is important to note that by providing a credit in one instance does not mean, nor obligate us, to provide the credit again.
We may at times change or add new fees; we will however always notify you prior to booking or invoicing for an event.
Rescheduling, cancellations, and refunds
Rescheduling is allowed up to 2 days before the date of an event for which a payment was completed, at no extra cost.
If we are forced to cancel an event, due to unforeseen circumstances (and/or outside our control) we will attempt to reschedule with you. Should this not be possible, a refund will be completed for the original amount paid.
If an event is canceled, we must be notified at least 5 days in advance. A full refund, minus a $25 administration fee will be completed.
For cancellations with less than 5 days’ notice, a 50% refund, minus a $25 administration fee, will be completed.
We will not refund or credit for partial or unused events, other than the terms listed above. Should there be extreme circumstances where you believe a refund should be considered, contact us via e-mail at email@example.com, or by phone at 519-591-5843. The decision to refund any amount (in part or in full) is ours, and at our discretion.
Please note all refunds will be completed via e-mail transfer unless otherwise agreed upon.
We may at time offer promotions. We may terminate, modify or change our promotions at any time, without notice and for any reason, at our discretion.
Promotions can only be used once and cannot be redeemed for cash, redistributed or combined with other offers. A valid payment is required when you redeem your promotion code.
Venues – Private events
If you host a KaleidoArt event in your home, you agree there will be a place for the facilitator to park their vehicle close to the main entrance of your residence. This parking area should be safe and legal. Should you fail to provide the facilitator with such place for their vehicle, you will be responsible for any fees or issues associated.
As a host, you are also agreeing that a non-alcoholic beverage be available to the facilitator, should they request one. You are also responsible to provide an area large enough to complete the event, including table and chairs big enough to hold all guests and materials required for every attendee to complete their artwork and an area for the facilitator to comfortably provide instructions and access to water. A bathroom, a sink, and garbage should also be easily accessible to the facilitator for set-up and clean up prior to and immediately after the event.
We will provide all materials required to complete the artwork (such as paint, canvases, paintbrushes, tablecloths, water containers, aprons). We will not provide any food or drinks for your event.
Only attendees approved by you may attend your event.
Venues – Third party locations
You may at a time, attend a KaleidoArt event at a third-party location, such as a bar or restaurant. This location may offer services to you for your convenience. Please note that KaleidoArt is not responsible for, nor do we endorse the food, beverages or services you will receive at these locations.
We are not responsible for your experience with the third party providers, and you are using their services at your own risk. KaleidoArt will not be held responsible for your experience, should you have concerns, issues, complaints or questions about the third party, you should contact them directly.
We disclaim all liability from your use of third-party services.
Reviews and Feedback
We encourage you to post reviews and feedback on events you’ve attended and your experience working with us. Note that your reviews are visible on our website and social media pages. We may modify or remove reviews and comments at our discretion.
Note that we will remove any and all reviews that we find to be inappropriate. By posting a review or comment, you agree that it may be made publically available.
Privacy and communication
By using our services, you agree that we may communicate with you via surveys, newsletters and other methods. If you no longer wish to receive any form of communication from us, inform us via e-mail at firstname.lastname@example.org.
Photography and film
We may take pictures or film at an event and will use those images at our discretion, to use on our website, social media posts and/or promotional and marketing materials, as we see fit.
Disclaimers / Legal stuff
You agree that the use of KaleidoArt.ca is at your own risk. We cannot guarantee our website to be uninterrupted or error-free. We also cannot guarantee the accuracy of the information available.
You also agree that we will not be held responsible or liable for delays, computer viruses, failure, theft, unauthorized access, or any other issues arising from the use of our website.
KaleidoArt is free to use any comments, information, ideas, reviews or any other material you may share with us, via e-mail, survey, social media posts, etc.
We may use any or all information shared with us to develop new services as well as market, promote, modify or improve our current services.
Any conflict you may have with KaleidoArt should be discussed with KaleidoArt. If an agreement cannot be reached any and all disputes will be resolved by arbitration and will not be brought to court. By agreeing to these terms and conditions, you agree to work with KaleidoArt and give up your right to go to court.
Neither parties (you or KaleidoArt) may be held liable to complete any agreed upon services (other than payment of money) in the event of fire, flood, earthquake, natural disasters, war, riot, intervention from government or “acts of God” as long as the party unable to complete their part of the agreement informs the other party as soon as available.
These terms and conditions are made in accordance with the laws of the province of Ontario, in Canada. If any term or condition is found to be invalid, unenforceable or in conflict with the law, it will be removed from the agreement. The remainder of the terms and conditions will still be considered valid.
We reserve the right to terminate or restrict the use of our services for any or no reason without notice, at our discretion.
You warrant that you have all rights and capacity as well as the power to agree to these terms on behalf of yourself and/or any other seeking the services of KaleidoArt.
